Felicia focuses her practice on complex intellectual property litigation. She has successfully led plaintiff and defense litigation on a large variety of claims related to patents, copyrights, trademarks, and trade dress. Her litigation experience spans several industries, including medical devices, software, music, pharmaceuticals, and manufactured goods. Felicia’s victories on behalf of clients have included successful preliminary injunction motions (Fitger's On-the-Lake, LLC v. The Fitger Company, LLC, et al., MSP Corporation v. Westech Instruments, Inc et al.), summary judgment motions, highly favorable settlements, and jury verdicts at trial. She is a registered patent attorney with a bachelor’s degree in chemistry and has represented clients in contested proceedings before the U.S. Patent and Trademark Office.Felicia has played a leading role in large patent infringement matters for several clients, including Guidant Corporation, Genetic Technologies Inc. and the University of Minnesota. As a result, Felicia has had extensive experience in complex case management; coordination of global discovery efforts; design and implementation of litigation strategy; investigation of underlying disputed issues; the selection and development of all experts, and Markman strategy, briefing and argument. With these skills, her representation of the University of Minnesota against Glaxo Wellcome, involving the antiviral drug Ziagen, resulted in a settlement for her client that was the most lucrative licensing agreement ever established for a public university, estimated at more than $300 million. Similarly, Felicia's Markman strategy and argument in a complex biotechnology patent dispute resulted in a stunning Markman ruling that drove the case to a favorable settlement (Genetic Technologies Limited v. Applera Corporation, (N.D. Ca, Civ. No. 03-1316), September 2004). Felicia’s litigation experience also includes the management of copyright enforcement campaigns for many clients including the Business Software Alliance, Microsoft, ASCAP, Motion Picture Association of America, Macromedia and the Recording Industry Association of America. |
