Litigation
Eugene P. Souther has practiced law since 1959. After serving as a litigation associate at Cravath, Swaine & Moore, Mr. Souther joined Seward & Kissel as a partner on April 1, 1968. Mr. Souther served for a number of years as head of the Litigation group and Chairman of Seward & Kissel. After 34 years as a partner, Mr. Souther became Senior Counsel to the Firm on April 1, 2002.
Mr. Souther's substantial litigation experience includes trials in federal and state courts in New York and other states, significant appellate practice, proceedings before the SEC, CFTC, NASD, NYSE, the EEOC and state and local human rights administrative agencies, as well as domestic and international arbitration proceedings and proceedings abroad under the Hague Convention. Mr. Souther's practice in federal and state courts covers a broad spectrum, including private securities litigation, class and derivative actions, private and public federal and state investigations and proceedings, and litigation involving employment discrimination, banking, bankruptcy, contracts, construction and partnership disputes.
Mr. Souther received a B.S. degree in 1953 from Fordham College and an LL.B in 1959 from Fordham University School of Law.
Mr. Souther is admitted to practice in New York and before the United States Supreme Court, the Court of Appeals for the Second and Ninth Circuits, the United States District Courts for the Southern, Eastern and Northern Districts of New York, the Tax Court of the United States and the United States Court of International Trade.
Mr. Souther is a Fellow of the American College of Trial Lawyers and served through the years on the New York Downstate Committee of the College.
From 1988 to 1990 Mr. Souther was President of the New York County Lawyers' Association. He served the Association in a number of other capacities, including Vice President, Member of the Board of Directors and Chair of the Finance, Judiciary and Nominating Committees.
Mr. Souther was a member of the Departmental Disciplinary Committee of the Appellate Division, First Department, from 1980 to 1987.
Mr. Souther served for many years in the House of Delegates of the New York State Bar Association and as a member of that Association's Nominating Committee. He has also served as a Delegate to the House of Delegates of the American Bar Association and as Vice Chairman of the International Bar Association Section on Business Law Committee on Procedures for Settling Disputes.
Mr. Souther has been appointed a Special Master by the United States District Court for the Southern District of New York to hear and report on disputes. He also was appointed an Arbitrator by the President of the Association of the Bar of the City of New York to hear and decide a dispute between an attorney and his firm.
Mr. Souther’s pro bono activities include serving for a number of years as Village Justice for the Villages of Bellerose and Muttontown in Nassau County and presently as a Member of the Board of Zoning Appeals of the Village of Lattingtown. |
