Mr. Benham is an associate in the firm's litigation and appellate practice sections. He has a business litigation practice in both federal and state courts with a particular emphasis on appellate litigation. Mr. Benham has represented clients on appeal in the Dallas Court of Appeals and has assisted in the representation of clients before other state appellate courts, the Texas Supreme Court, the United States Court of Appeals for the Fifth and Eighth Circuits, and the United States Supreme Court. He has handled a variety of matters before those courts including legal malpractice, catastrophic personal injury, trademark disputes, criminal matters involving the United States constitution, defamation and malicious peer review in the medical staff context, employment disputes, contract disputes, personal injury resulting from sexual abuse, and matters involving state and federal procedure. In addition to his appellate practice, Mr. Benham also represents and assists in the representation of clients before state and federal trial courts. His clients include individuals, corporations, partnerships, and other business organizations. Representative matters include commercial disputes, personal injury cases, and property disputes. Mr. Benham's role has ranged from assisting with discovery and motion practice in multi-million dollar litigation, to the first chair trial of a temporary injunction in state district court, and primary responsibility for dispositive motions in federal court. Mr. Benham has also assisted trial lawyers outside the firm by drafting complex motions involving procedural and substantive issues and drafting jury charges at or before trial. In doing so, he helps to "level the playing field" in motion and jury charge practice while freeing up the lawyer to focus more of his or her energy on preparing and trying the case. Mr. Benham was admitted to practice in Texas in 2006. He has also been admitted to practice before the United States District Court for the Northern District of Texas and the United States Court of Appeals for the Fifth Circuit. |
