David S. Almeida is an associate in the Commercial Litigation Practice Group. David represents clients in federal and state courts throughout the United States. He has been involved with a wide range of cases and areas of law, including hospitality, products liability, franchise disputes, commercial fraud, business torts, governmental investigations, bankruptcy and health law.
Prior to moving to Chicago, David was an associate with Milbank, Tweed, Hadley & McCloy LLP in New York City. During law school, David was a law clerk at the U.S. Attorney's office for the District of Maryland (Baltimore) and an extern for the U.S. Attorney's Office for the Northern District of Georgia (Atlanta).

Food Management Group, LLC, et al. v. Matrix Realty Group, Inc., 372 B.R. 171 (S.D.N.Y. 2007). Trial counsel in successful litigation against prospective purchaser of debtors' Dunkin' Donuts stores and other assets. At the conclusion of the trial, the Honorable Adlai S. Hardin, Jr. found in our client's favor that the prospective purchaser had breached the $26.7 million contract.
Recently obtained jury verdict in favor of international food retailer against claims for fraudulent business practices.
Currently representing national and regional retailers in consumer class actions brought under the Fair and Accurate Credit Transactions Act.
Currently representing numerous health maintenance and managed care organizations against putative class actions alleging claims of inadequate reimbursement and violation of Illinois Consumer Fraud and Prompt Payment Acts.
Represented Fortune 50 pharmaceutical manufacturer in series of complex products liability litigations brought in state and federal courts throughout the United States. Successfully opposed class certification of putative nationwide classes in multiple cases.
Successfully represented Drug Emporium, Inc. in case of first impression wherein franchisees alleged that creation of franchisor's www.drugemporium.com website infringed upon the franchisees' protected areas.
Conducted internal investigation and successfully represented Nevada casino in actions by the Nevada and Missouri Gaming Commissions regarding alleged ex parte contacts.
Successfully represented class of low income persons with AIDS in suit against the City of New York, compelling amendment of New York City Charter to provide medically appropriate housing to plaintiffs.

Named one of the country's "Outstanding Healthcare Litigators" for 2007 by Nightingale's Healthcare News.
David received his J.D. degree from Cornell Law School in 1999. While in law school, he was an editor of the Cornell Law Review and authored a note entitled: "Voluntary Disclosure: Saving Grace or Potential Death Knell for Corporate Health Care Providers."
David received his bachelor's degree, summa cum laude, in 1995 from Salisbury University. |
