David J. Brooman is a partner in the Environmental Practice Group, a managing partner of the firm, and regional partner in charge of the Berwyn office. He represents a cross-section of clients, including public and private companies, municipal governments, developers and lenders in applying environmental law and making sound land use decisions.
Environmental and Land Use Counseling and Permitting. David counsels clients in all areas of environmental permitting and compliance, concentrating in contaminated sites, solid waste, sewage facilities, air and water. David also is an established land use practitioner, concentrating in the siting and permitting of complex facilities and controversial developments.
Enforcement. David counsels on-going operations and landowners in resolving outstanding environmental violations under the Solid Waste Management Act (SWMA), Clean Streams Law (CSL), Sewage Facilities Act (SFA), Resource Conservation and Recovery Act (RCRA), Toxic Substances and Control Act (TSCA) and similar environmental initiatives. David has extensive experience in litigating before the Environmental Hearing Board, DEP and similar federal and state environmental agencies.
Environmental Litigation. David has broad experience in all facets of complex environmental enforcement and litigation matters. He has prosecuted and defended clients under a variety of environmental statutes including the National Environmental Policy Act (NEPA), SWMA, CSL, SFA, RCRA, TSCA and other environmental programs. David has extensive experience in multi-party CERCLA and HSCA sites and has structured several creative settlements with regulatory agencies and PRPs. David is currently spearheading the successful remediation of the largest HSCA site in Pennsylvania and several private cost recovery actions.
Transactional. David represents clients in a host of corporate, lending and real estate transactions, managing environmental risk and ensuring compliance with all aspects of federal, state and local environmental laws and regulations. David is versed in the recent state and federal Brownfields’ initiatives and is actively involved in the development of several Brownfields sites, combining a strong relationship with the regulators and a strong technical background.
In General. David received a bachelor's degree from Rutgers University and his J.D. cum laude from Villanova Law School. He is a past chairman of the Environmental, Mineral and Natural Resources Law Section of the Pennsylvania Bar Association, and a past president and current member of the Board of Directors of the Pennsylvania Resources Council. David is a member of the American, Pennsylvania and Philadelphia Bar Associations and frequently lectures on environmental and land use topics for area universities, the Pennsylvania Bar Institute and the Pennsylvania Bar Association. David’s pro bono commitment is to children. He is a volunteer attorney and active member of The Support Center for Child Advocates representing abused and neglected children throughout Philadelphia. David was recently recognized for his fifteen year pro bono commitment through the Support Center’s Outstanding Advocate Award. |
