David Isenberg is Of Counsel in the Global Corporate Department of Milbank, Tweed, Hadley & McCloy LLP. He has been associated with the Firm since 2001.
Mr. Isenberg specializes in the structuring, documentation and resolution of secured transactions, including secured lending transactions, secured public debt issuances and secured private debt issuances, in each case with respect to both senior and junior secured positions in the capital structure. Mr. Isenberg represents clients on both sides of new financing transactions. Mr. Isenberg has particular experience in the representation of secured creditors in workouts and loan restructurings. He has been involved in out of court restructurings and bankruptcies in a wide variety of industries, including: cemeteries, commercial real estate development, trucking, retailing, energy, equipment leasing, franchising, mass media, manufacturing and high technology. He frequently represents secured creditors, agents for syndicated lender groups and bondholders.
Mr. Isenberg speaks and writes frequently on issues related to intercreditor arrangements and resolution of distressed debt. Mr. Isenberg is the co-author with Gregory A. Bray of "Distressed Debt Investing - Risk Considerations" in The Handbook of Loan Syndications and Trading, Allison Taylor and Alicia Sansone (McGraw Hill 2007) and the author of "Toward a Compromise on Collateralizing Loans to Broadcasters" in 45 Federal Communications Law Journal 541 (1993). Mr. Isenberg is also a regular contributor to The Journal of Corporate Renewal, where his most recent articles are "Risk Considerations When Investing in Distressed Debt" (Vol. 19 No. 12, December 2006) and "'Silent Firsts Offer Alternative to Typical Intercreditor Terms" (Vol. 19 No. 6, June 2006). Mr. Isenberg is a member of the American Bankruptcy Institute and the Commercial Bankruptcy Committee of the American Bar Association.
Mr. Isenberg received his Bachelor of Arts in Economics from UCLA with honors in 1983 and his JD from UCLA School of Law in 1986, where he was Recent Updates Editor on the UCLA Pacific Basin Law Journal. |
