Dan is an associate in the litigation department and focuses his practice on employment law, litigation and dispute resolution. He regularly advises employers on compliance and litigation avoidance related to state and federal employment laws and regulations, NASD rules, and third party compliance agency procedures; represents clients before administrative, regulator and investigative agencies; and represents employers in state and federal court, and arbitration venues, in a variety of employment matters including non-competition disputes, protection of trade secrets, employment discrimination and other issues that arise in the human resources and employment areas. Dan is experienced in handling employment-related matters in a wide variety of industries, including securities, manufacturing, high technology, health services, biotechnology, engineering, and real estate development and management, to name a few. Dan also assists employers with drafting employment related contracts, policies and documents, including employee handbooks and policies, employment agreements, covenants not to compete, separation agreements, and other employment documents. Dan served as law clerk to The Honorable William L. Osteen, U.S. District Court for the Middle District of North Carolina, 2003-2004.
Representative Matters
Obtained summary judgment in favor of local manufacturer in case involving claims of race and age discrimination.
Defended interaction technology company in wrongful discharge lawsuit brought by former executive, resulting in settlement favorable to the client.
Drafted, reviewed, and negotiated various types of employment-related agreements, including employments agreements, non-competition, non-solicitation, non-disclosure agreements, and severance packages for departing employees.
Represented numerous employers in discrimination investigations before the EEOC.
Represented NASD member firm in non-competition arbitration.
