Lead trial counsel representing management in employment litigation including claims of wrongful discharge, violations of public policy and various discrimination claims based upon sex, age, race, disability, religion, pregnancy and marital status.
Wage and hour litigation in state and federal courts on multiple issues including exempt status, meal and rest periods and penalties.
Lead counsel in ERISA litigation in defense of plans and plan fiduciaries on claims for benefits by plan beneficiaries.
Lead counsel in defense of businesses against tax assessments by EDD based upon the agency's assertion of employment status for the independent contractors used by my clients.
Lead counsel in defending against claims of unfair competition and misappropriation of trade secrets.
Lead counsel in the case of Mary M. v. Capital City Foods, Inc ., where a writ was obtained overturning the denial of our summary judgment motion based upon the argument the plaintiff failed to establish a sufficient nexus between the sexual assault by a co-employee and employment to trigger liability on the part of the employer.
Advocate and neutral arbitrator/mediator in multiple arbitrations and mediations of employment and business disputes.
