Dana R. Kaplan primarily counsels clients on trademark, unfair competition, copyright and U.S. Customs matters. Her clients include many well-known clients in the entertainment, financial, publishing, apparel, fashion, Internet, computer, toy and food industries. Ms. Kaplan's experience encompasses all aspects of trademark law, including litigation before the U.S. Patent and Trademark Office and in the federal courts, prosecution, licensing, and rendering opinions on the availability or registrability of trademarks, domain names and company names. Ms. Kaplan also is very effective at settling cases for her clients and strives to do so whenever possible, in an effort to avoid costly litigation.
Ms. Kaplan has worked on many litigations for high profile clients and has extensive court experience. For example, Ms. Kaplan helped Marvel Enterprises, Inc. successfully defend against a motion for a preliminary injunction brought by Twentieth Century Fox Film Corporation, wherein Fox sought to enjoin the television series "Mutant X." In another case, Ms. Kaplan negotiated a favorable settlement for a hedge fund client resulting in another hedge fund having to completely change its name.
Prior to joining Kenyon & Kenyon LLP, Ms. Kaplan supervised and ran investigations involving counterfeit merchandise, and organized and participated in civil seizures of such merchandise on behalf of large apparel and footwear companies. During this time, Ms. Kaplan worked with members of the New York City Police Department and the Manhattan District Attorney's Office to help combat counterfeiting.
Ms. Kaplan is the Assistant Chair of Kenyon & Kenyon LLP's Trademark Practice Group, as well as a member of the firm's Associates Committee. She also speaks on various trademark issues, most recently at IQPC's Anti-Counterfeiting & Brand Protection seminar in October 2006 in New York City.
