Cliff's practice involves litigation in both the state and federal courts at the trial and appellate levels, and before both state and federal agencies. Cliff has acted as lead trial counsel in jury and non-jury trials and in contested hearings before administrative agencies, and he has argued before the Maine Supreme Judicial Court. Cliff's practice focuses on complex litigation and general commercial litigation. He has served as trial counsel for the State of California in its $4 billion challenge to a series of long-term energy contracts before the Federal Energy Regulatory Commission, the appeal of which was decided in the State's favor by the Ninth Circuit (Public Utilities Commission of the State of California v. FERC, Docket No. 03-74207), and has acted as defense counsel in a number of multimillion dollar class action lawsuits in both state and federal courts. Cliff also has served as liaison counsel to defendants in the two matters that have been transferred to date to the District of Maine by the Judicial Panel on Multidistrict Litigation for pretrial proceedings (MDL 1361 In re Compact Disc Minimum Advertised Price Antitrust Litigation and MDL 1532 In re New Motor Vehicles Canadian Export Antitrust Litigation).
