Mr. Gaspar is an associate in the Intellectual Property Litigation section of the Milbank, Tweed, Hadley & McCloy LLP Litigation Department. His litigation, prosecution, and counseling practice includes a wide range of technologies and products, but is primarily devoted to matters involving electrical, computer, business-method, and mechanical fields. Before joining Milbank, Mr. Gaspar was associated with Morgan & Finnegan, LLP.
Mr. Gaspar has significant intellectual property litigation experience before various federal district courts, state courts, and the United States Court of Appeals for the Federal Circuit. This experience includes litigating patent validity and enforceability, patent infringement and damages, trade secret misappropriation, unfair competition, and antitrust claims. He has represented successful litigants in the following recent matters:
Global Charter Services Ltd. v. Greer, 71 USPQ2d 1537 (Ill.Ct. 2004) (TRO and permanent injunction in trade secret matter)
The Equitable Life Assurance Society of the United States et al. v. Byrd et al. (TRO and preliminary injunction in trade secret matter)
Valleylab, Inc. et al. v. Aspen Laboratories Inc. et al. (bench trial on inventorship issues)
Mr. Gaspar has written and prosecuted hundreds of patent applications, filed in the United States and abroad, directed to a wide variety of technologies. He has also negotiated and prepared numerous license agreements for intellectual property, and counsels clients on issues such as the licensing and patentability of technology, the infringement and validity of United States patents, patent infringement avoidance, and strategies for developing and exploiting intellectual property assets.
Mr. Gaspar is an active member of several intellectual-property associations, including the Intellectual Property Owners Association (where he co-chairs the Trade Secrets/Employee Mobility/Restrictive Covenants Subcommittee), the New York Intellectual Property Law Association, and the American Intellectual Property Law Association.
Mr. Gaspar is a member of the bar in the State of New York, the District of Columbia, and the State of Missouri. He is admitted to practice in the United States Court of Appeals for the Federal and Fifth Circuits, as well as the United States District Courts for the Southern District of New York, the District of Colorado, and the Western District of Missouri. Mr. Gaspar is also registered to practice before the United States Patent and Trademark Office. |
