Experience:

Christophe Dugue is a partner in Mayer Brown's International Arbitration - Litigation Group. He has represented multinational corporations and government-owned entities in numerous international commercial arbitration cases, both ad hoc (including UNCITRAL) and institutional (mostly under the rules of the ICC and the French Arbitration Association), in English and French and under a variety of applicable laws. His practice as lead counsel and counsel in transnational and domestic disputes relates to a variety of contractual, construction, oil and gas, joint venture and banking matters involving such industries as chemicals, finance, oil & gas, construction and defense. His litigation experience includes a broad range of commercial disputes before the French courts, mostly with an international element, in areas including banking/finance, construction, post-acquisition disputes and arbitration related matters.

Christophe also has a broad experience in corporate and banking law, as well as international finance, structured finance, securization, derivatives and project finance. He joined Mayer Brown Paris in January 2008. Prior to that, he was a partner in the international arbitration group of another major global law firm in Paris where he started as an associate (1990-1996) and then became European counsel in 1997. From 1983 to 1990, he practiced as in-house counsel for two major French banks in Paris.

Recent or pending arbitrations in which Christophe Dugué has appeared as lead counsel and counsel include the representation of :

A European chemical company as claimant and respondent in a series of ad hoc (with a seat in Switzerland) and ICC (with a seat in Paris) arbitration cases together with related litigation before US courts against European subsidiaries of a North-American chemical company. Cases relate to joint venture and confidentiality agreements governed by French law and by Swiss law.

A European chemical company as respondent in an ICC arbitration in Paris against a European holding company. French law applied. The dispute concerned the interpretation of a joint venture agreement following the purchase by the claimant of a share of 50 % in a joint venture company. The amount at stake was in the order of EUR 155 million. In June 2006 an award was rendered that fully endorsed the respondent's interpretation of the agreement.

A European chemical company as claimant in an ICC arbitration in Paris against the European subsidiary of a North-American chemical company. The dispute concerned the interpretation of a joint venture agreement governed by French law. The case also involved EC law issues. The amount at stake was in excess of USD 130 million. In June 2005, the arbitral tribunal rendered an award that fully endorsed the claimant's interpretation of the agreement.

The companies exploiting the channel tunnel as respondents in an ICC arbitration in Amsterdam against the railways in a dispute concerning the sharing of the channel tunnel operating expenses. The amount at stake was in excess of USD 170 million and an award by mutual consent was rendered in May 2005.

One of the world's largest semiconductor company against a silicon wafers producer in an ICC arbitration. The supplier sought USD 70 million for breach of contract. Applying French law, the tribunal determined in July 2003 that the supplier had never achieved the ability to supply that was a condition of the contract.

A North African owner as claimant in an ICC arbitration in Geneva against a European energy distributor and its construction contractor subsidiary. Algerian law applied and French was the language of the arbitration. The claimant was seeking over USD 500 million in damages under a cost-plus-fee contract for the renovation of a petrochemical plant. Issues included liability for delay and determination of the price. The matter was settled on terms favorable to claimant.

A European company active in the defense industry in an ICC arbitration in Paris against a North-European defense contractor. French law applied and the language of the arbitration was English. The dispute concerned the performance of an agreement to prepare a joint bid for a major defense contract. Settlement was reached after the exchange of written submissions.
