Professional Experience
Mr. Roux represents construction owners and contractors in connection with public and private projects involving infrastructure, commercial, industrial and residential works of improvement. He regularly provides construction counseling to clients on the myriad issues that arise in the construction business, including project planning and procurement, drafting and negotiating contracts, claims avoidance and the resolution of legal issues that commonly arise on construction projects.
He has substantial experience both prosecuting and defending multi-million dollar public and private extra work, delay and disruption claims in all forums, including state and federal courts, administrative hearings and arbitrations. Mr. Roux also has considerable experience litigating construction defect claims where he has represented owners, general contractors, specialty subcontractors and suppliers.
Mr. Roux has represented clients in connection with the construction of projects which include heavy industrial and infrastructure construction (refineries, processing plants, power plants, wastewater treatment plants, cement plants, sewers, bridges, airports), commercial projects (malls, department stores, office buildings, sports stadiums, convention facilities, hotels), hospitals, schools and jails, as well as residential single family and condominium projects.
Mr. Roux regularly speaks on issues such as bid protests, project start-up and close-out, claims, mitigation strategies, mechanic´s liens, SB800, and False Claims Act liability. He authored a chapter on "Construction Contract Pass-through Clauses" which was published in the 1999 Edition of BLI´s "Construction Contracts Deskbook". He is currently co-authoring a book on school siting and construction, which will be published by Solano Press in August 2005.
