Charles is a trial lawyer with considerable courtroom and arbitration experience handling a wide variety of complex commercial disputes, products liability (involving chemicals, asbestos, machinery and aircraft), insurance coverage and employment matters. In commercial matters, Charles has represented clients as both plaintiffs and defendants, achieving results in both capacities. Charles was named by Texas Monthly magazine as a Texas Rising Star Super Lawyer in 2005 and 2006 and as a Texas Super Lawyer in 2007.
REPRESENTATIVE EXPERIENCE
Charles has served as counsel in a variety of recent litigation matters, including the following:
A series of arbitrations for a large health care management company involved in a number of disputes with large physician practice groups. In these matters, Charles has obtained multimillion dollar verdicts in favor of his client in the plaintiffs' capacity and dismissals or very favorable settlements in the capacity of a defendant.
Litigation counsel representing an official committee of unsecured creditors in a multibillion dollar valuation dispute that was litigated during the summer of 2005 in Federal Bankruptcy Court in Fort Worth, Texas.
A $100 million preference dispute that was litigated in the Federal Bankruptcy Court for the Southern District of New York. The matter settled in favor of client following trial and post-trial briefing.
An arbitration representing the Houston mass transit authority in a warranty dispute with a manufacturer that resulted in a mid-six-figure award.
Four related lawsuits representing a Fortune 500 company that had been sued by a group of former employees seeking millions of dollars in damages for wrongful termination and related claims. The cases were dismissed on motion practice, which was recently upheld on appeal.
Co-lead in a series of matters representing a national franchisor that was facing fraud and unfair competition claims from a group of franchisees. The last of these matters was recently settled on terms favorable to the client.
Counsel for a publicly traded energy company in a Delaware Chancery Court trial over a failed merger with another publicly traded energy company.
Lead counsel for a Fortune 500 company in an injunctive matter involving a contract dispute over the refurbishing of a 767 aircraft. Defeated injunctive action and prevented seizure of the aircraft.
Lead counsel in an insurance coverage dispute, resulting in a six-figure verdict in favor of client.
Co-counsel representing a regional airline carrier in an arbitration involving a dispute with a major carrier concerning compensation rates.
