Chuck Waterman is a partner in the Bricker & Eckler energy, public utilities & environmental law practice group. He practices environmental law, emphasizing counseling in matters including air pollution control, water pollution control, solid and hazardous wastes, toxic substances, environmental policy, planning, compliance and enforcement defense. He provides representation before all local, state and federal environmental agencies and state and federal courts.
Representative Experience
Obtained and successfully defended through administrative and judicial appeals the first two siting and operating permits awarded to two proposed hazardous waste treatment and storage facilities (incinerators) by the Ohio Hazardous Waste Facility Approval Board; required federal permits were also obtained, only the second and third such permits issued by the United States Environmental Protection Agency
Assisted in securing federal and state PSD approvals and air pollution source installation and operating permits for largest greenfield manufacturing facility of its type in the United States
Assisted in securing air, water and solid waste permits for several landfills including the largest in the state
Participated as applicant's counsel in the first mediated resolution of a hazardous waste facility siting permit application
Acted as defense counsel in the first mediated resolution of a state water pollution enforcement complaint, securing a 70% reduction in civil penalties sought against the client-defendant
Won significant limits on the scope of citizen suit jurisdiction under federal hazardous waste law in a series of cases decided by the 4th and 6th U.S. Circuit Courts of Appeals
