Charles G. Middleton, III, managing director of the firm, is an experienced civil litigator in complex litigation. He has handled the resolution of numerous complex business disputes both inside and outside the court room. Most of his practice has been in the federal court system. These cases include Superfund litigation, insurance coverage disputes, breach of contract, patent infringement, wrongful death actions, securities fraud and antitrust litigation. Mr. Middleton has been involved in eminent domain proceedings, both in civil litigation and in alternate dispute resolution. Such representations in the past included the taking of special use properties, such as service stations, mineral reserves, mobile home parks, manufacturing properties, as well as residential and commercial properties.In the antitrust field, Mr. Middleton has represented both companies and individual corporate officers subpoenaed before the federal grand jury on criminal proceedings. Mr. Middleton has been trial counsel in major national antitrust litigation including the Piper Antitrust litigation and the Cement Antitrust litigation, both of which were certified national class actions. His experience in environmental litigation has included numerous regulatory hearings before the USEPA Administrator and in the United States Federal Court for regulatory compliance arising out of RCRA-Hazardous Waste, underground petroleum storage tanks, air quality emissions, NPDES permitting and SPCC plans. He has presented cases in the administrative arena for permitting and certifying utility plants and manufacturing plant additions, for both land use and environmental compliance. In addition, Mr. Middleton handled large construction contract claims for construction of utility plants, manufacturing, commercial shopping centers and other real estate complexes. Such claims include resolution without litigation of multi-million dollar cost escalation claims, negligent design, contract buy-outs, and other construction disputes.Mr. Middleton has also worked closely with the owners and managers of small or privately held businesses. In numerous instances, he has been successful in the strategic planning process to preserve the family in small business succession.Mr. Middleton is a member of the American, Kentucky and Louisville Bar Associations. He has also been appointed by the Board of Governors to a four year term as one of the four lawyer members to the Joint Local Federal Rules Commission from the Western District of Kentucky. |
