Mr. Burkhalter handles complex business disputes in most any field, including ordinary tort and contract cases, securities arbitrations, antitrust litigation, and appellate work. The overwhelming majority of his cases are multi-million dollar controversies.Representative Cases:Mr. Burkhalter has tried over twenty commercial matters, both in the court system (federal and state) and through arbitration. He has never lost one of these court trials. In arbitrations, where panels frequently "split the baby," he has won a zero -- a complete victory -- over 75% of the time. In only four arbitrations was he unable, as lead counsel, to obtain a zero; in each of the four cases the suing parties recieved less than 10% of what they had requested in damages. Some of Mr. Burkhalter's trials have been covered by The Wall Street Journal, Los Angeles Times, The Miami Herald, and local media outlets, including newspapers in Birmingham and Montgomery. As an appellate lawyer, Mr. Burkhalter has handled numerous appeals to the Alabama Supreme Court and the United States Court of Appeals for the Eleventh Circuit. Over the last ten years, he has won approximately 90% of the appeals in which he has participated. Mr. Burkhalter's appellate work includes a unanimous Alabama Supreme Court decision reversing a $27 million jury verdict and rendering a judgment for the defendant, thus avoiding a new trial and any exposure for the client. Mr. Burkhalter's plaintiffs' work includes representation of the shareholders of Community Bank in litigation against the bank's former CEO. The litigation ended with a multi-million dollar settlement, the CEO's termination from the bank, and his conviction on federal criminal charges. Mr. Burkhalter also helped secure a $27.5 million jury verdict in a plaintiff's case tried in Jefferson County Circuit Court in 2005.Prior To Maynard Cooper:Mr. Burkhalter served as a law clerk for Judge E. Grady Jolly of the United States Court of Appeals for the Fifth Circuit.Outside the Office:Mr. Burkhalter is a Tuscaloosa, Alabama native.
