Bryan's practice concentrates primarily on civil and appellate litigation and real estate development. His litigation practice emphasizes defending governmental entities in constitutional, civil rights (42 U.S.C. § 1983), property damage, and employment matters. He also has significant experience representing employers against wrongful termination and discrimination related claims and in litigating real property issues and disputes. Bryan was named in Utah Business magazine as one of Utah's Legal Elite in the area of Business Litigation.
Bryan is an experienced appellate lawyer. He has successfully briefed and argued numerous cases before Utah's appellate courts on issues ranging from the proper standards governing applications to change the use and point of diversion of water rights, to due process notice requirements for municipal land use decisions, to payment of overtime compensation under the Fair Labor Standards Act. In addition to handling appeals of cases arising from his original trial representation, Bryan has served as appellate counsel in cases handled at the trial level by attorneys both in and outside the firm.
In his real estate development practice, Bryan regularly counsels developers in all stages of the development process. His emphasis is the creation and establishment of planned communities. His projects have ranged from small residential condominiums to large master planned golf course communities. He also represents homeowner associations and individual owners on issues related to community association governance.
