Brian Henninger's litigation practices focuses on construction, real estate and product liability disputes.
Brian represents both contractors and owners in construction litigation involving breach of contract, architect/engineer liability, structural design defects, product design defects, unexpected conditions, subcontractor performance and complex delay damages. Much of his work in construction matters involves contract controversies, including the representation of both home improvement contractors and home owners in contract disputes that arising under M.G.L. c. 142A ("Regulation of Home Improvement Contractors"). Brian not only handles trial work, he also counsels both contractors and owners about the potential risks and benefits associated with construction contract termination.
As an adjunct to his construction work, Brian counsels retail companies and property managers on numerous disputes arising from use and/or ownership of commercial and residential property, such as personal injury claims, commercial lease disputes and injury or property damage caused by design defects.
In addition, Brian represents pharmaceutical drug manufacturers in defense of numerous product liability claims in state and federal courts in Massachusetts and the District of Columbia, as well as in defense of product liability claims transferred to the Multi-District Litigation Panel.
