Brent A. Hawkins is a partner in the law firm of McDermott Will & Emery LLP based in the Chicago office. Brent is a member of the Intellectual Property, Media & Technology Department and focuses his practice on intellectual property litigation, counseling and procurement.
Prior to joining McDermott, Brent practiced in a full-service intellectual property law firm. Brent has acted as litigation counsel in numerous patent, trademark, trade dress, unfair competition and copyright matters.
Brent is experienced in the procurement, defense and enforcement of patent rights in a variety of technologies, including voice recognition and recordation software, two-way communication devices, wireless synchronization and data packet transmission technology, acoustic transducers, electrical switches, transformers, aeration devices, electrical fuses, paper converting technology and printing technology.
In addition to his litigation experience, Brent regularly prepares and prosecutes patent applications in the mechanical, electro-mechanical and software arts. In addition, he is experienced in appellate practice before the Board of Patent Appeals and Interferences.
Brent's practice also includes intellectual property asset management. In particular, he has experience in performing due diligence investigation, analyses and opinions in connection with the sale or acquisition of businesses or targeted business assets involving various technologies, including: multi-band antenna technology, 2G (CDMA) and 3G (W-CDMA) wireless communication protocol technology, ethernet switching technology, semiconductor technology, paper converting technology, optical elements and current control regulators for lighting systems and polymer intermediates.
His practice also includes trademark clearance and prosecution. Brent has also represented clients in inter partes trademark opposition and cancellation proceedings before the Trademark Trial and Appeals Board.
Brent has been recognized by Law & Politics as an Illinois Rising Star (2008). He is a member of the adjunct faculty of both the University of Illinois College of Law and the John Marshall Law School. He has also conducted numerous lectures including, "Patent Litigation Program - Injunctive Relief in Patent Litigation" for the Practising Law Institute; "Protection of Architectural Drawings and Designs Under U.S. Copyright Law" at the American Institute of Architects National Convention; and "Trademark Portfolio Acquisition & Protection" for Law Seminars International.
Additionally, Brent serves on the Board of Directors of Ada S. McKinley Community Services, Inc., the Evening Associates of the Art Institute of Chicago and the Academy of Global Citizenship contract school. He is also the Treasurer of the IPLAC Educational Foundation. Brent is a member of the American Bar Association, American Intellectual Property Law Association, International Trademark Association, Chicago Bar Association and the Intellectual Property Law Association of Chicago.
Brent is admitted to practice in Illinois and before the Supreme Court of the State of Illinois, the U.S. Court of Appeals for the Federal Circuit, the U.S. District Court for the Northern District of Illinois, the U.S. District Court for the Central District of Illinois, the U.S. District Court for the Eastern District of Wisconsin and is registered with the U.S. Patent and Trademark Office.
