Bijal V. Vakil is a partner in the law firm of McDermott Will & Emery LLP based in the Silicon Valley office. As a member of the Intellectual Property, Media & Technology Department, Bijal focuses his practice on all aspects of intellectual property, including litigating patent, trademark, copyright, technology licensing and other related disputes.
Bijal represents clients in a large variety of high-tech industries including biotechnology and computer hardware and software. His experience also includes representation of international entities in resolving intellectual property issues in the United States. Also, Bijal has successfully litigated before numerous federal district courts and in the United States International Trade Commission (ITC).
Bijal has represented numerous technology companies including Business Objects, Gemstar-TV Guide International, Inc., Med El, Intergraph Corporation, First International Computer, Inc., O2Micro, Visa International, Panasonic, Matsushita and Medtronic, Inc. JuxtaComm. v. Business Objects (ED TX) - representing Business Objects in ongoing patent litigation in Tyler, Texas.
Samsung v. Matsushita and Panasonic - successfully represented Matsushita and Panasonic in obtaining a favorable settlement resolving cases in New Jersey, Texas and the Court of Appeals for the Federal Circuit.
Matsushita v. MediaTek (ND CA and ED TX) - represented Matsushita and Panasonic in a series of patent lawsuits in San Francisco, California and Marshall, Texas involving MediaTek relating to semiconductors and consumer electronics products resulting in favorable settlement for Matsushita.
Siliconix v. Panasonic (ND CA and ED TX) - successfully defended Panasonic in patent infringement action resulting in favorable worldwide settlement.
02Micro v. Monolithic Power - represented patent holder in litigation in Northern District of California.
Edwards v. Medtronic - initiated claim of ownership of accused infringing patent resulting in settlement of patent litigation.
Intergraph Hardware Technologies Company Inc. v. Hewlett-Packard Company (and related actions) - represented Intergraph in six patent infringement cases against Hewlett-Packard in California, Texas and Germany, resulting in a significant settlement for Intergraph.
International Rectifier v. First International Computer - represented FIC in patent case that settled favorably.
Johnson v. Visa International - successfully represented Visa International and Visa U.S.A. in obtaining dismissal of patent infringement and trade secret action.
Intel v. First International Computer - represented First International Computer in favorable settlement of patent infringement action.
Med El v. SoundTec - successfully represented Med El in obtaining a settlement of its action for misappropriation of trade secrets.
In re Certain Set-Top Boxes and Components Thereof - represented Gemstar - TV Guide in one of the largest Section 337 investigations (and in parallel district court proceedings) involving several patents relating to interactive program guides used in cable and satellite set-top boxes resulting in a successful settlement from EchoStar, Pioneer and Scientific-Atlanta.
American Imaging Services, Inc. v. Intergraph - prevailed on obtaining complete dismissal of all claims of patent infringement for Intergraph.
Intergraph Corporation v. Intel - represented Intergraph in obtaining a favorable settlement against Intel.
Intergraph Corporation v. Texas Instruments - represented Intergraph in obtaining a favorable settlement against Texas Instruments.
Hewlett-Packard Company v. Intergraph Corporation - represented Intergraph in successfully obtaining a finding of non-infringement at trial in Germany.
In law school, Bijal was the senior articles editor of the U.C. Davis Journal of International Law and Policy and was a member of Phi Delta Phi. He has served as a judicial extern to the Honorable Alex Kozinski of the U.S. Court of Appeals for the Ninth Circuit and to the Honorable James N. Barr of the United States Bankruptcy Court for the Central District of California.
Bijal is admitted to practice in all state and United States District Courts in California. He is admitted to practice before the U.S. Supreme Court. He has been nominated to the Empire Who's Who of Executives and Professionals. Bijal serves as a Judge Pro Tem for the Superior Court of Santa Clara and also serves on the State Bar Committee on Federal Courts. He served as the Hiring Partner for the Firm's Silicon Valley Office. Bijal is a member of the Federal Circuit Bar Association, the South Asian Bar Association and a current board member (President-2006) of the Asian Pacific Bar of Silicon Valley. He is also the alternate Regional Governor for the National Asian Pacific Bar Association. Bijal is also on the board of the Asian Law Alliance (the largest provider of legal services for the Asian and Pacific Islander community in Santa Clara County). Bijal frequently speaks on legal topics of interest to the community.
