Beth L. Jacobson is a senior associate in the Litigation and Government Contract and Grants Departments of our Boston office. Prior to joining Sullivan & Worcester, Ms. Jacobson was a Law Clerk for Associate Justice Barbara A. Lenk of the Massachusetts Appeals Court and was also a law clerk to the Justices of the Superior Court of Massachusetts. Ms. Jacobson represents business and individual clients in a broad range of commercial and financial litigation, with a special emphasis on cases arising out of complex corporate and financial transactions, including enforcing restrictive covenants, trade secrets and contractual and shareholder disputes. Ms Jacobson also represents companies in pre-award and post-award bid protests at the Government Accountability Office and in the Court of Federal Claims. Ms. Jacobson has significant trial experience having second-chaired two major trials (one six-weeks and one two-weeks) and has argued successfully at the Court of Federal Claims in a high-end bid protest. Representative Client Work Represented the largest records and information management services company in multiparty litigations involving the enforcement of restrictive covenant and fiduciary duties in State Courts and Federal Arbitration. Successfully represented a NYSE-listed company in multiple litigations arising out of charges of tortious conduct and unfair competition designed to drive the competitor out of business and causing approximately $60 million in alleged damages. After a six-week trial in 2004 the court dismissed all claims against the client. Represented plastics manufacturer in two-week trial involving contractual disputes, trade secret issues, and enforcement of non-competition and non-disclosure provisions, successfully defending client from counterclaim. Represented minority shareholders in litigations involving breaches of fiduciary duties including corporate freeze-outs involving internet service provider and real estate businesses. Worked closely with experts in valuing companies and damages analyses for trial. Successfully retained jurisdiction for high value client in bid protest in Court of Federal Claims. Successfully argued Motion for Limited Discovery in Court of Federal Claims for high value client involved in a bid protest with the United States. Represented high value client in bid protests with the United States. Represented technology company and successfully settled contractual dispute involving payment of real estate commission. Represented professor and researcher and successfully settled claims involving allegations of non-payment of fees. Represented not-for-profit organization and successfully settled dispute with landlord and prevented eviction of client.
