Beatrice Nguyen is a litigation partner in FLK's San Francisco office, focusing her practice on complex litigation involving antitrust, intellectual property, and unfair competition law. Ms. Nguyen has experience representing both plaintiffs and defendants in complex litigation.
Ms. Nguyen joined FLK in 1994. In addition, she served as an extern law clerk to Judge Saundra Brown Armstrong, United States District Court for the Northern District of California.
Representative Matters
Defending major car rental company in case involving claims for federal and state antitrust violations, interference with prospective economic advantage, unfair and deceptive business practices, and unfair competition.
Representing Cisco Systems, Inc. in its iPhone trademark infringement lawsuit against Apple Inc.
Representing and successfully obtaining summary judgment in favor of four pharmaceutical companies in a complex California state court antitrust case brought by a group of retail pharmacies, which involved price-fixing claims under California's Cartwright Act and Unfair Competition Law.
Representing PeopleSoft, Inc. in its lawsuit against Oracle Corp. in connection with Oracle's hostile tender offer for PeopleSoft, which involved claims for interference with prospective economic advantage, unfair competition, and violation of Cal. Bus. & Prof. Code §§ 17200 et seq. Approximately one month prior to trial commencing, Oracle increased its tender offer price, resulting in an increase of value to the stockholders.
Representing Seiler & Company, LLP in its fee dispute with Bank of America, N.A. in an arbitration, which involved claims of breach of contract, unjust enrichment, and fraud, and successfully obtaining an award of compensatory damages as well as attorneys' fees and costs.
