Mr. Loftin is a native of Huntsville, Alabama and has practiced law in Huntsville since graduating from law school in 1991. He is a member of the firm's Litigation section and regularly represents clients in State and Federal Courts as well as Alternative Dispute Resolution proceedings. His practice focuses primarily in the area of commercial litigation including banking litigation, shareholder disputes, manufacturer and sales representative litigation, securities, business and corporate litigation. Representative Cases: Served as lead counsel and obtained a dismissal of a class action on behalf of a national rental car company in a class action dispute involving allegations of fraudulent charges. Served as lead counsel and obtained a preliminary and permanent injuction for a national telecommunications company against individuals claiming harassment and threatening the company to take information public concerning their operation. Served as lead counsel for a national telecommunications company in a dispute concerning payment of potential severance benefits due as a result of a change in control. Obtained a favorable settlement for client. Represented a publicly traded software company in a dispute over earn out provisions and asset purchase agreement. The litigation involved valuing a $25M software license revenue stream in 26 countries and resulted in a $7.9M recovery for our client, as well as a successful dismissal of a counterclaim filed by the defendant. The electronic document production by parties exceeded several million pages. Served as lead counsel in an action for a publicly traded software company successfully piercing the corporate veil of a defendant and obtaining a judgment against the individual officers in the amount of $1.6M. Served as lead counsel for a multi-national publicly traded company in a class action and alleging fraud and deception out of a telemarketing practice. We upheld an arbitration agreement, obtained a dismissal of the class allegations and the individual lawsuit. Served as lead counsel for a local finance company in several class actions alleging violations of Small Loan Act, Mini-Code violations and RICO violations. Obtained a dismissal in three of the actions and obtained favorable settlements in the three other class actions. Served as lead counsel for a manufactured representative company in an action where we obtained a $975K verdict against a publicly traded company in the United States District Court for the Northern District of Alabama. Served as lead counsel for the defense in a government contracts dispute where a national government contract company filed a multi-million dollar claim in Northern Virginia against our client. The complaint alleged theft of business, tortuous inference of business relations, corporate conspiracy in conspiracy to hire employees. Obtained a favorable settlement on behalf of the government contracting client. Represented a local company in an intellectual property dispute concerning the validity of two patents and allegations of patent infringement. Our efforts resulted in favorable settlement for our client. Represented a national medical waste company, and its president, in a dispute over the purchase of a local medical waste company. After several years of litigation, we obtained a favorable settlement on behalf of the client and president. Served as lead counsel in a securities fraud case involving the sale of several million dollars in shares in a local technology company. After obtaining a summary judgment on a majority of the claims asserted by the plaintiff, we obtained a favorable settlement on behalf of the client. Regulary serve as lead counsel for two national banks in financial litigation involving all sorts of claims made against the financial institutions, including lender liability and claims under Articles III and IV of the U.C.C. Regularly represent closely held corporatoins and/or their officers in claims alleging breach of fiduciary duty, the tort of corporate oppression, and other contractual and corporate disputes. |
