Astrid R. Spain is a partner in the law firm of McDermott Will & Emery LLP based in the San Diego office. Astrid is a member of the Intellectual Property, Media & Technology Department and the Life Sciences & Medical Devices Practice Group where her practice spans patent counseling, prosecution and litigation in the life sciences and pharmaceutical industries.
Astrid's clients represent many sectors of the pharmaceutical and biotechnology industries, including both start-up ventures and well-established branded companies. Astrid frequently assists clients with the development and implementation of streamlined and business oriented intellectual property strategies. She focuses on the shaping of patent portfolios that achieve offensive and defensive goals in view of competitive technologies and life-cycle management. Astrid has significant experience in the preparation and prosecution of U.S. patent applications as well as the management of corresponding foreign proceedings. Astrid's practice also includes the preparation of numerous validity, infringement and freedom to operate opinions on biotechnology and pharmaceutical patents. A substantial portion of Astrid's practice is devoted to patent litigation and her litigation experience includes participation in a lengthy jury trial involving recombinant DNA technology.
Astrid is a co-editor and regular contributor to McDermott's IP Update. She also frequently comments and publishes on topics related to intellectual property law. While at law school, Astrid served as Note & Comment editor of the Loyola of Los Angeles Law Review and was a finalist in the Scott Moot Court Competition. Prior to attending law school, Astrid earned a graduate degree in the Department of Cellular, Molecular and Developmental Biology at UCLA. Astrid has co-authored scientific publications in several peer-reviewed journals.
Astrid is a member of the state bars of California and the District of Columbia and is admitted to practice before the U.S. District Court for the Southern District of California. She is also registered with the U.S. Patent and Trademark Office.
