Andrew W. Goldwater
Andrew W. Goldwater's practice focuses on complex litigation involving debt, equity and derivatives trading, securities, corporate and partnership law, bankruptcy, and contract and other commercial disputes. He represents hedge funds, asset managers, bondholder groups and financial services companies, as well as bankruptcy estates, committees, and litigation trusts.
His recent matters have included representation of:
a litigation trust prosecuting breach of fiduciary claims against the former majority stockholder of a well-known media company arising out of the stockholder's agreement to restrict the company's financing activities and obtain the company's assistance in connection with the stockholder's issuance of debt securities;
buyers and sellers of distressed debt and other claims in connection with a variety of disputes involving failed trades, credit agreement and trust indenture issues, and other disputes;
a well-known asset manager in successfully defending against a bankruptcy estate's effort to disallow and subordinate the manager's claims;
former directors and officers of a bankrupt manufacturing company in successfully defending against claims arising out of pre-bankruptcy asset sales; and
a real estate company and its principal in successful defense of claims by a foreign contractor accusing our clients of participating in a RICO conspiracy to bribe a government official to terminate unfavorable subcontracts.
Mr. Goldwater graduated magna cum laude from Tufts University in 1978 and received his law degree in 1981 from New York University School of Law, where he was Research Editor of the Moot Court Board. He is a member of the Association of the Bar of the City of New York and has served on its Committees on Federal Courts, Federal Legislation, and State Legislation. He is also a member of the Federal Bar Council and the American Bar Association Sections of Litigation and Business Law.
