Andy Foster is a partner in the firm's Environmental Practice Group where his practice concentrates on complex federal and state environmental litigation. Andy also regularly advises clients regarding environmental issues in business and real estate transactions, and provides general regulatory counseling across a wide range of environmental statutes and programs.
Environmental Litigation. Andy has broad experience in complex, multiparty environmental litigation on behalf of large and small companies. He has prosecuted, defended, tried and settled numerous claims for private cost recovery, contribution and indemnification under Superfund and related federal and state statutes. Andy's environmental litigation practice also includes administrative proceedings before the EPA and Pennsylvania's Environmental Hearing Board, as well as remedy and performance litigation among owners, environmental consultants and contractors. In addition, Andy has litigated property damage, toxic tort and related claims involving waste, water and air.
Other Commercial Litigation. In addition to his concentration in environmental law, Andy handles all facets of general commercial litigation, including real estate and partnership disputes, commercial landlord-tenant matters, construction litigation, contract claims, securities law, trade secret disputes and products liability defense.
Environmental Counseling. Andy's regulatory practice includes counseling under a broad range of environmental programs, including the federal Superfund program, Pennsylvania Act 2 and Brownfields cleanups, solid and hazardous waste disposal, Clean Water and Clean Air Act permitting, EPCRA compliance, stormwater regulations, underground tank removal issues and advice regarding environmental investigations and audit programs. Andy frequently handles environmental due diligence investigations in connection with a variety of business and real estate transactions, including management of Phase I and II Audits, real property investigations and the negotiation and structuring of environmental risks in connection with mergers and acquisitions, and the lease, purchase, or sale of assets and real property.
In General. Andy is a past co-chair of the Environmental Law Committee of the Philadelphia Bar Association and a member of the Natural Resources and Litigation Sections of the American Bar Association. He has served as an adjunct professor at the University of Pennsylvania, teaching environmental law and policy in both The Wharton School and the Environmental Studies Masters Degree Program. |
