Mr. McGuinness practices commercial and complex litigation, including international disputes, and federal and state trial and appellate practice. A major focus of his practice is class action litigation, including securities, consumer finance, retail and antitrust cases. Mr. McGuinness has extensive experience in securities litigation, with an emphasis on defense of securities class actions. He has defended numerous corporations and individual defendants in such actions, and has worked on cases establishing new pleading standards for securities class actions within the Sixth Circuit (covering federal courts in Michigan, Ohio, Kentucky, and Tennessee). He has defended numerous consumer financial class actions, including suits against major retailers, credit card companies, TILA and CROA claims, and recently obtained dismissal of a mortgage financing class action on preemption grounds. He was previously appointed Co-Editor of Securities News, the newsletter of the American Bar Association Litigation Section's Securities Litigation Committee. He is also a subcommittee chair for the ABA Litigation Section's Derivative and Class Action Committee. Prior to joining Dykema, Mr. McGuinness clerked for the 1st Circuit Court of Appeals and practiced law for four years with Skadden, Arps, Slate, Meagher & Flom in Chicago. While in law school, he was articles editor of the Michigan Law Review and served on the Campbell Moot Court Board. |
