Andrew focuses his practice on financial restructuring, bankruptcy, and creditors' rights issues that arise during commercial and various other transactions.
His practice also includes defending lender liability claims, sales of specific and entire portfolios of troubled assets, and restructuring classified loans, including the preparation of forbearance agreements, as well as traditional commercial litigation matters. He also provides alternative solutions to the various financial challenges that individuals and businesses engaged in commercial transactions encounter, including many areas of bankruptcy, refinancing, litigation, and commercial and residential foreclosures.
Andrew's recent representations include:
Identification of regional opportunity for and subsequent representation of secondary market lender in due diligence, closing on purchase, workout and foreclosure of a $7 million asset from institutional lender.
Litigation of breach of factoring agreement and negotiation of inter-creditor agreement resulted in recovery on behalf of financial institution of more than 100% of the amount due and owing under factoring agreement.
Breach of contract and fraudulent conveyance litigation on undersecured letter of credit resulted in recapture of all outstanding principal, interest and legal fees.
Bankruptcy litigation resulted in plan payments to client in excess of $250,000 and release of six-figure letter of credit held by the debtors' assignee.
Representation of of landlord in disputed assumption of commercial lease hearings in Chapter 11 reorganization of nursing home that resulted in new lease forms favoring landlord, including mandatory escrow of real property tax payments and upgraded capital expenditure requirements.
Prior to joining Buchanan, Andrew worked at a large firm in Rochester, New York, where he was the coordinator of a litigation team that serviced the bankruptcy and foreclosure needs of institutional clients. He also focused on work with creditors' rights and commercial litigation.
While in law school, he was a senator of the Student Bar Association, and a member of the Phi Delta Phi legal fraternity. He also received an Academic Excellence Award, as well as Distinguished Academic Achievement Awards in Remedies and Advanced Torts. |
