Mr. Kitchen has defended life insurance companies in a variety of cases pending in California, Texas, Florida, Georgia, Kentucky, Virginia, Tennessee, Mississippi, Colorado, Indiana, New Jersey and Ohio, in addition to actions here in Alabama. Mr. Kitchen has also represented companies in mass tort environmental actions, personal injury lawsuits, contract disputes and workers’ compensation claims. Representative Cases: Mr. Kitchen has extensive experience in matters involving fraudulently procured insurance policies. Over the past four years, Drew has been responsible for the investigation and legal pursuit of nearly 50 policies believed to have been obtained by fraud, resulting in a savings of nearly $30 million to various carriers. Drew has also spoken at industry meetings on the topic of insurance fraud. Mr. Kitchen is lead counsel for a Fortune 500 company in various actions throughout Alabama involving the alleged improper sale and marketing of life insurance. Mr. Kitchen obtained summary judgment for a Fortune 1000 insurance company in a Denver, Colorado Federal District Court in a bad-faith case involving alleged misrepresentations on a life insurance application. The policy proceeds at issue exceeded $1.5 million. In 2007, Mr. Kitchen obtained summary judgment in Georgia in a bad-faith insurance lawsuit involving an applicant who died during underwriting. The amount at issue exceeded $500,000. Mr. Kitchen is currently co-lead counsel in five purported nationwide class actions pending in Georgia and New Hampshire. Outside the Office: In 2006, Mr. Kitchen ran the Marine Corps Marathon, learned to fly fish, played semi-professional baseball for the Birmingham Pirates, and coached little league football.
